Mediation is a method of resolving disputes in which another person (the mediator) works impartially with those in dispute, to assist them to communicate with one another, negotiate and ultimately reach an agreement.
One of the great benefits of using mediation to resolve a dispute is that you will be directly involved in developing the final solution. With other forms of dispute resolution, such as arbitration or taking a case to court, the final solution will be imposed on you. These other forms will give you an opportunity to argue your case, but in the end it is someone else's solution that you will have to accept.
A lasting resolution is much more likely when the parties have been actively involved in creating it. With the skilled assistance of a professional mediator, it is the parties themselves who construct their own agreement. It's worth noting too that mediation is an essentially private and confidential process.
A key to the success of a mediation is open and honest communication between the disputants, which is best achieved in a confidential process. I'm based near Hamilton and conduct mediations throughout Auckland, Waikato, Bay of Plenty, the King Country and Hawkes Bay.
